PENA - TERMS OF USE OF THE SERVICE
These Terms of Use document ("Terms") apply to your use of PENA application, secure communication services, websites, software, and all related features (hereinafter referred to as the "Services"). By installing, creating an account, or using PENA, you agree to these Terms.
If you do not agree to these Terms, you may not use the Services.
1. Definition
For the purposes of this document:
- "PENA" means the Super Application, the platform, and the entire technical infrastructure used to provide communication services.
- "User" means the individual who installs, accesses, or uses the Services.
- "Content" means all forms of data, including text messages, audio, video, files, images, and other information sent or received through the Service.
- "Software" means the client application, site, backend system, and technical components associated with the service.
- "You" means each individual user of the Service.
2. Scope of Service
PENA provides a secure communication platform that includes:
- Encrypted text, audio, and video messages
- Voice and video calls
- File, media, and voice delivery
- Video & Call Group
- Advanced privacy and security features
PENA does not provide cloud storage for message history, and does not collect personal data other than what is technically necessary.
3. User Eligibility Requirements
To use the PENA, you represent that:
- You are at least 13 years old, or within the applicable legal age in your jurisdiction.
- You have the legal authority to enter into this agreement.
- You are not prohibited from using digital communications services under the laws of your country.
4. Account Registration and Security
4.1 Information Required
PENA allows the creation of accounts with no phone number. Identity information is optional and is not required to use most features.
4.2 Your Responsibilities
You are responsible for:
- Keeping your device secure
- Not sharing access credentials
- Using the official version of PENA
4.3 Unauthorized Activities
You cannot:
- Access someone else's account
- Use unauthorized methods to log in or get services
- Compromise the security or integrity of the system
5. Proprietary Rights and Licenses
5.1 Rights to the Software
PENA grants you a limited, non-exclusive, and non-transferable license to use the app.
You are not allowed to:
- Modify, copy, or distribute apps
- Perform reverse engineering, decompilation, or code extraction
- Use the PENA brand, logo, or visual display without written permission
5.2 User Owned Content
All the content you submit remains entirely yours.
PENA does not acquire any ownership rights to user content.
6. Privacy and Data Management
PENA is built on the principle of privacy as the main foundation. All PENA services are designed so that users have full control over their data, communications, and digital activities, without data collection or storage by PENA.
6.1 Not Collecting Data
PENA does not collect, store, or process users' personal data, including but not limited to identity, communication content, files, calls, or transaction activities.
6.2 Full Control in the Hands of the User
All messages, files, and data are encrypted and processed locally on the user's device, using end-to-end encryption and Real Peer-to-Peer (P2P) architecture, so only the user has access to the data.
6.3 Zero-Access and Self-Custody
PENA applies the principle of zero-access, where PENA does not have technical access to users' data, communications, or digital assets.
For wallet services, PENA applies the principle of self-custody, so that the private key and control of Bitcoin assets are completely in the hands of users.
6.4 Advanced Encryption
PENA uses:
- 3.20 F (Post-Quantum) Encryption for communication services, and
- 3.20 N (Post-Quantum Cryptography) Encryption for PENA Wallet (BTC only),
designed to protect users from current security threats as well as future computing threats (Quantum Computing).
6.5 Data Storage
PENA does not provide data storage on a central server. All user data is only stored locally on the user's device according to the selected settings.
6.6 User Responsibilities
The User is solely responsible for:
- device security,
- Recovery Phrase storage,
- and the use of PENA services in accordance with applicable law.
7. Content and User Behavior
You are responsible for the content you submit. You agree not to use the PENA to:
- Illegal activities
- Fraud, threats, or harassment
- Spread of malware or malicious files
- Copyright infringement
- Child exploitation
- Spread of extremist or harmful content
PENA reserves the right to take action in the event of a violation that is proven based on a valid technical assessment.
8. Terms of Communication Services
8.1 Service Reliability
PENA strives to provide stable service, but does not guarantee:
- Uninterrupted service
- Compatibility with all devices
- No bugs or errors
- Malware scan to send files, photos, videos
- PENA Wallet (BTC Only)
- Share Location with 100% accuracy rate
- Unlimited Sending Files
- Secure Communication
- VPN
8.2 Storage and Deletion
Because they are serverless, deleted messages cannot be recovered from any server.
8.3 User Blocking
You can block other users. PENA can restrict access to users who violate rules or laws.
9. Paid Services
PENA provides premium features:
- Fees and payment terms will be explained separately
- Refunds follow the distribution platform's policies
- Premium features don't affect basic security and privacy
10. Intellectual Property Rights
All visual elements, interface design, illustrations, text, icons, logos, and technology are the property of PENA.
Use without written permission is prohibited and may be subject to legal action.
11. Suspension and Termination of Service
PENA can suspend or terminate your access if:
- You are breaking the law
- Use apps for malicious activity
- Interfere with service integrity
- Sending illegal content
- Misusing apps for spam or attacks
Termination can be temporary or permanent.
12. Disclaimer of Liability
PENA is not responsible for:
- Damage that arises from using the app
- Loss of data on your device
- Loss of access due to damaged, lost, or stolen devices
- Content posted by other users
You use the service at your own risk.
13. Limitation of Liability
To the extent permitted by law:
- The PENA is not responsible for indirect damage
- Not responsible for economic losses
- Not responsible for loss of personal data beyond technical control
14. Changes to the Terms
PENA reserves the right to update these Terms. Important changes will be notified via:
- App notifications
- Announcement on the official website
Continuing to use after a change means that you agree to the new version of these Terms.
15. Dispute Resolution & Applicable Law
Disputes will be resolved in accordance with the applicable laws of the region in which the service manager establishes operational jurisdiction.
If the dispute cannot be resolved informally, the settlement is carried out through arbitration or legal mechanisms in accordance with the provisions of the relevant country.
